Lloyds Bank is part of Lloyds Banking Group, which also includes Halifax and Bank of Scotland. We see Lloyds documents for both homes and businesses: occupier’s consent forms and family-supported purchases on the mortgage side, and guarantees and security from directors on the business side.

Some family-assisted mortgages use a relative’s savings or property as extra security. Where that happens, the lender may ask the helper to take independent legal advice, because their money is at risk if the borrower doesn’t pay.

What your solicitor will do

Your solicitor reviews the Lloyds documents, explains the risks privately, and confirms the decision is yours. If you go ahead, they complete the certificate in the lender’s wording.

When you might need independent legal advice

Family-assisted mortgages

Relatives supporting a buyer with savings, security or by joining the mortgage.

Occupier's consent

Adults living in a mortgaged property who aren't borrowers.

Business guarantees

Directors guaranteeing company loans and overdrafts.

Third-party charges

Using your property to secure someone else's borrowing.

Frequently asked questions

Does this page cover Halifax and Bank of Scotland?

The same types of advice apply, but each brand may use its own documents and certificate. Send us what you've been given and we'll make sure the right wording is used.

Do I need to use Lloyds's own certificate?

If Lloyds has given you a certificate or form for the solicitor to sign, use it. Send it to us before your appointment so your solicitor can complete it in the right wording.

Does Lloyds accept independent legal advice by video?

Many lenders now accept video advice, but requirements change and can differ between products. Check Lloyds's instructions, or ask your broker. If a face-to-face meeting is needed, we can arrange one in London.

Are you connected to Lloyds?

No. My Online Lawyer is independent of Lloyds. We connect you with an SRA-regulated solicitor who acts only for you.

My Online Lawyer is not affiliated with, endorsed by or acting for Lloyds. We use the name only to describe documents our clients have been asked to sign. Always follow your lender’s own instructions, and check its requirements with your broker or the lender if you’re unsure.
